Terms of Service

1. Acceptance
By accessing polemica.ca or using any Polemica service, you agree to these Terms of Service. If you do not agree, do not use the site or services. These terms apply to all visitors, clients, and anyone who interacts with our platform.
2. Services
Polemica provides AI workforce automation tools including but not limited to:
- —AI employees (front desk, estimating, purchasing, billing, reputation, follow-up)
- —Business process automations (lead follow-up, appointment booking, review requests)
- —B2B portals for dealers, distributors, and suppliers
- —Private AI systems trained on client knowledge bases
Services are provided on a subscription or project basis as described in your service agreement. We reserve the right to modify or discontinue services with reasonable notice.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access. Polemica is not liable for losses resulting from unauthorised use of your account.
4. Payment
Subscription fees are billed monthly in advance. Setup fees are charged at the time of onboarding. All fees are in Canadian dollars unless otherwise stated. Failure to pay may result in suspension of services. We do not offer refunds on setup fees. Monthly subscriptions may be cancelled at any time with 30 days written notice.
5. Acceptable Use
You agree not to use Polemica services to:
- —Violate any applicable law or regulation
- —Send spam, unsolicited messages, or engage in deceptive practices
- —Transmit harmful, offensive, or fraudulent content
- —Attempt to reverse-engineer, copy, or resell our software or AI systems
6. Intellectual Property
All software, AI models, workflows, and content created by Polemica remain the intellectual property of Polemica Inc. Configurations and automations built specifically for your business using your data remain yours. You grant Polemica a limited licence to process your data solely to deliver the contracted services.
7. Limitation of Liability
Polemica is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability in any month is limited to the fees paid by you in that month. AI systems can make errors — you are responsible for reviewing and approving AI-generated communications before they affect critical business decisions.
8. Governing Law
These terms are governed by the laws of Alberta, Canada. Disputes shall be resolved in the courts of Alberta. If you are a consumer in Quebec, applicable provincial consumer protection laws apply.
9. Changes to These Terms
We may update these terms at any time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the services after the effective date constitutes acceptance of the updated terms.
